New Delhi, Apr 14: The Supreme Court on Monday said that Madhya Pradesh Governor Lalji Tandon was right in ordering the floor test in the state assembly.
A bench headed by Justice DY Chandrachud passed the order with respect to its earlier order on March 8. It passed the 68 page judgement on powers of the Governor. "Have given a detailed judgment on Constitutional law and powers of Governor", Justice DY Chandrachud said.
Justice Chandrachud said, in this case the Governor of MP was right in ordering the floor test. Governor did not take any decision by himself. Governor called a floor test," the bench said.
The Apex Court affirmed the Governor's decision to call for a floor test and said there was no impediment to the Governor asking a CM to show majority when he has good reasons to believe so.
Justice DY Chandrachud said, Governor can exercise this power in a running assembly too. SC rejected the contentions by former chief minister Kamal Nath, and Madhya Pradesh Congress that the Governor can at best call for a session but not ask for a floor test in a running assembly.
The Top Court relied on SR Bommai judgement while passing the order today. (UNI)
