The legal battle on Madhya Pradesh floor test has begun in the top court with counsel for Congress, Dushyant Dave slammed BJP saying Congress MLAs were kidnapped and BJP destroys constitutional morality.
Reading excerpts from the Constituent Assembly debates (1946-50), Dave argued that the saffron party was destroying constitutional morality. "Democracy in India is only a top dressing of Indian soil, which is essentially undemocratic," quoting Ambedkar, Dave said.
Dushyant Dave also argued that a trust vote can't be held unless the assembly constituencies of the 22 rebels are represented. Dave read out a letter in which Chief Minister Kamal Nath asked Governor Lalji Tandon to get to the bottom of the 'kidnapping' of his MLAs.
It's up to the Governor to ask the BJP to bring the MLAs to Bhopal and determine if the resignations were forced, but he isn't doing that, Dave said.
