Nirbhaya convicts seek stay on execution; assert all legal options not exhausted

New Delhi, Jan 30: Special Judge AK Jain on Thursday, after hearing a plea on behalf of convicts in the 2012 Nirbhaya gang rape and murder case for stay of execution on February 1, issued notice to Tihar Jail authorities and sought their reply.

Counsel for convicts sought stay on execution, scheduled for February 1, arguing that legal remedies of some of them are yet to be availed. He said that according to the Delhi Prison rules, none of the four convicts in the same crime can be hanged till the exhaustion of all legal options, including the mercy petition.

Prosecution submitted that it is a "complete mockery of justice". He said that a notice was served on December 18 and the convicts are filing mercy petiton after 40 days. Judge Jain today after hearing the plea directed Tihar Jail Authorities to file a status report on convicts' petition seeking stay on the execution scheduled for February 1, Saturday.

He directed Tihar Jail Superintendent to file a reply on their plea by 10 am on Friday. (UNI)
