CBI gets Chidambaram’s custody till Aug 26


New Delhi, 22 August, 2019: Special judge Ajay Kumar Kuhar said Chidambaram could meet his family members and his lawyers for 30 minutes every day during the custody.

However, the court, allowed family members and lawyers to meet Chidambaram for 30 minutes a day. Further the court has also directed medical examination of the septuagenarian leader every 48 hours.

“Considering all facts and circumstances,.I am satisfied that police custody of Chidambaram for five days is fully justified”, judge Kuhar said. The judge gave his order after hearing arguments on his behalf and on behalf of the CBI which went for three hours in the packed court in which his wife and senior advocate Nalini and Son Karti were also present besides battery of reporters.

In the court room at Rouse Avenue, New Delhi senior Congress leaders Harish Rawat and Mukul Wasnik were present. Two senior legal luminaries Kapil Sibal and Abishekh Manu Singhvi represented Chidambaram. For the CBI, Tushar Mehta, Solicitor General of India represented. Chidambaram’s wife, Nalini and son Kartik were also in the court when the court heard the case.

After hearing arguments from senior Congress counsel Kapil Sibal and Abhi Manu Abishekh and CBI counsel and Additional Solicitor General Tushar Mehta, the judge delivered his order only after two hours.

Earlier overruling objections from CBI lawyer, the judge allowed Chidambaram to make his submissions. Chidambaram said he was repeatedly asked if he had any foreign accounts. Hetold them CBI interrogators neither he nor any of his family members had any foreign account.

Earlier, S-G Thushar Mehta, the government’s second most-senior law officer, who appeared for the CBI, sought 5 days of custody of Chidambaram for the interrogation. Solicitor General Tushar Mehta said the ex-minister’s responses to investigators were evasive and his custodial interrogation was crucial.

Both senior lawyers and Congress leaders Kapil Sibal and Abhishek Manu Singhvi argued for Chidambaram against CBI counsel’s custody demand. Raising the fact that Chidambaram will never skip interrogation, Senior counsel and Congress leader Kapil Sibal has argued against five-day remand of Chidambaram sought by CBI at the CBI special court on Thursday. “CBI cannot say Chidambaram evasive in investigation. Grant of bail is a rule and the issue before court is of personal liberty.What is stated in case diary is not the truth,” Kapil Sibal tells court. The thrust of the argument of Sibal and Singhvi was that only Chidambaram had been arraigned while six Government secretaries were involved in the Foreign Investment Board clearance given for foreign investments of RS 305 crore in INX Media .

Former Finance Minister P.Chidambaram, who was arrested by CBI on Wednesday evening, was produced before CBI Special court by 3.30 pm on Thursday. Immediately after the court pronounced its order, Chidambaram was taken back to the CBI headquarters.
