A 5 judge Constitution bench has been formed in the Supreme Court on Monday to hear the petition moved by 2 Congress MPs. They had challenged the rejection by Rajya Sabha Chairperson Venkaiah Naidu of the impeachment motion against the Chief Justice of India.
The bench comprising Justices A.K.Sikri, S.A.Bobde, N.V.Ramana, Arun Mishra and A.K.Goel will hear the petition on Tuesday. Justice Sikri who is number 6 in the seniority list will head the panel. It may be noted that the matter has not been listed before the judges who are number 2 to 5 in seniority. These are Justices J. Chelameswar, Ranjan Gogoi, M.B.Lokur and Kurian Joseph who had held the controversial January 12 press conference.
In their petition, the Congress MPs Pratap Singh Bajwa and Amee Harshadray Yajnik had claimed that Venkaiah Naidu’s rejection had been ‘motivated by political consideration beyond the constitutional scheme.’
