In a bid to thwart the DNA test that CPIM politburo member and Kerala party secretary Kodiyeri Balakrishnan's son Binoy Kodiyeri moved Bombay High Court for quashing the FIR filed at the Oshiwara police station in Mumbai. According to the current FIR, Binoy Kodiyeri will have to undergo in the rape and cheating charges and a DNA test to verify the accuser’s claim.
The case is expected to come up for consideration on July 24. Binoy is to appear before the investigation officer at the police station on Monday. Last week, Binoy avoided undergoing the test claiming he was not well.
It is in this backdrop that he moved the High Court last week seeking quashing of the FIR. He has been accused of raping, sexually assaulting and cheating a former dance bar girl in Dubai on the promise of marrying her.
The relationship started in 2008 and the woman has an eight-year-old child of the marriage. Till 2015, Binoy used to give money regularly for their upkeep. Later in 2018, the woman learned that he was already married and turned hostile to demand Rs 5 crore. She complained that Binoy and his mother tried for compromise and when that failed, she started receiving threats.
Binoy had gone into hiding after police came to Kerala to arrest him and moved the sessions court for anticipatory bail which was granted on strict conditions, including visiting the station every Monday for a month and also undergoing DNA test if demanded.
The moving of the High Court is seen as a bid to thwart the DNA test which he had been opposing. Binoy's argument is that the charges against him on the FIR are false. There were several contradictions in the woman's statement.
