The Supreme Court on Monday stayed Kerala High Court’s verdict setting aside LDF-backed independent candidate Karat Razak’s election as legislator from Koduvally.
The apex court allowed Razak to attend the Assembly, though he would not be eligible to take part in voting or receive emoluments as MLA. The High Court on January 17 set aside the Karat's election on grounds of indulging in corrupt practices.
It had granted conditional stay to let Karat file an appeal in the Supreme Court. Two voters from the constituency, KP Mohammed and Moitheen Kunji had alleged that Karat and his agents had screened a video clip across the constituency during the poll campaign with the intention of tarnishing the image of IUML candidate MA Razak.
The High Court found sufficient evidence to prove charge and set aside the election.
