Supreme Court stays FIR against Major Aditya

The Supreme Court on Monday stayed the FIR against Major Aditya. The Court issued notice to the Centre and Jammu and Kashmir governments and directed them to file replies within two weeks.

The Supreme Court has sought the assistance of AG K.K. Venugopal in the matter.

Staying the action against Major Aditya, the Supreme Court has made it clear that no coercive action should be taken against him. “The verdict is a major victory for Indian Army.”, said Aishwarya Bhati, the counsel for Major Aditya.

Defence analysts say that this Supreme Court decision will boost the confidence of the Indian Army.

The Jammu-Kashmir Police had lodged an FIR under Section 302 (murder charge) against the Major Aditya and his unit for opening fire on a stone-pelting mob in Ganovpora village in Shopian on January 28. The army defended Major Aditya and criticised the state government for filing the FIR. The incident prompted Chief Minister Mehbooba Mufti to order a probe into the killings. The incident of stone pelting and assault by an unruly and disruptive mob on the Army personnel in the Shopian district of Jammu & Kashmir took place on the 27th January 2018.
