HC clears Chandy of sexual abuse charges

Former chief minister of Kerala Oommen Chandy was cleared of sexual abuse charges levelled by Saritha Nair, accused in the solar scam. Saritha had written a letter making allegations against Chandy’s sexual exploitation. The letter was allegedly written by Saritha while in jail in July 2013. It was produced before the commission in 2016 as evidence. Chandy had contended that the commission’s findings were based on Saritha’s letter and that the commission had gone beyond the scope of the terms of reference under which it was constituted.

This letter has been expunged by the HC from the report of the commission that probed the scam. The report based on the letter had been very damaging to the UDF leaders mentioned in it

Justice AK Jayasankaran considered the pleas of both Oommen Chandy and Thiruvanchoor Radhakrishnan to quash the commission’s report which had used Saritha’s letter as evidence. The court also advised the government to review any action taken by it based on the Solar commission’s report.

The court however dismissed a petition filed by former Home Minister Thiruvanchoor Radhakrishnan. The commission’s findings were that Radhakrishnan had made efforts to ensure that Oommen Chandy was extricated from criminal charges by influencing the police officers under him.
